Finances & Protection at Woodstock Legal Services

Dividing finances on separation can be complex, covering the family home, savings, pensions, businesses and ongoing maintenance. Getting the right advice helps you reach a fair outcome and protect your long-term future. Where someone’s safety is at risk, quick and effective legal action is essential. Woodstock Legal Services advises clients on both across England and Wales.

Our family lawyers advise on financial settlements on divorce and dissolution, consent orders and clean breaks, pension sharing, spousal maintenance, financial disclosure and court proceedings, prenuptial and postnuptial agreements, and non-molestation and occupation orders.

You’ll work directly with an experienced lawyer who explains your options in plain English, gives you a realistic view of the likely outcome, and handles your matter with care and discretion.

Financial Settlements & Agreements

When a marriage or civil partnership ends, the court can make orders dividing assets such as property, savings, investments and pensions, and deciding whether maintenance should be paid. The aim is a fair outcome, with the needs of any children coming first.

Our lawyers guide you through financial disclosure and negotiate a fair settlement on your behalf. Once terms are agreed, we draft a consent order for the court to approve, making the agreement legally binding. Where agreement can’t be reached, we represent you in financial remedy proceedings. We also draft and advise on prenuptial and postnuptial agreements for couples who want to plan ahead.

We work closely with our residential property team where the family home is being transferred or sold, giving you joined-up support from one firm.

Protective Orders

If you’re experiencing domestic abuse, harassment or threats from a partner, former partner or family member, the law can protect you. Protective orders can be put in place quickly, in some cases without the other person being told in advance.

Our family lawyers advise on and apply for non-molestation orders, which prevent someone from using or threatening violence, harassing or intimidating you, and occupation orders, which can decide who lives in the family home. We act quickly, handle your matter sensitively and confidentially, and guide you through every step of the process.

Finances & Protection FAQs

  • How are finances divided on divorce?

There’s no fixed formula. The court considers factors such as each person’s income, assets and needs, the length of the marriage, contributions made to the family and, above all, the needs of any children. Many couples reach agreement through negotiation or mediation, which is then formalised in a consent order. We’ll explain what a fair outcome might look like for you.

  • What is a consent order?

A consent order is a legally binding court order that records the financial agreement between you and your former spouse or civil partner. Once approved by the court, it can be enforced if either party doesn’t comply. A consent order can also achieve a clean break, ending future financial claims between you.

  • Are pensions included in a financial settlement?

Yes. Pensions are often one of the most valuable assets in a marriage and can be shared through a pension sharing order, offset against other assets, or subject to an attachment order. It’s important to get pensions valued properly before agreeing a settlement. We’ll advise on the best approach for your situation.

  • Are prenuptial agreements legally binding?

Prenuptial agreements aren’t automatically binding in England and Wales, but the courts will usually give them significant weight if they’re fair and both parties entered into them freely. Both parties should also have had full financial disclosure and independent legal advice, and the agreement should be signed well before the wedding. We can draft and advise on prenuptial and postnuptial agreements.

  • What is a non-molestation order?

A non-molestation order is a court order that prevents a person from using or threatening violence, or harassing or intimidating you or your children. In urgent cases, it can be granted without the other person being notified beforehand. Breaching a non-molestation order is a criminal offence. We can advise you and act quickly to make an application.

Why Choose Woodstock Legal Services?

Low Caseloads: Your Matter Gets Time

As consultants, our family solicitors manage their own caseloads and only work for a handful of clients at any one time. During a divorce or separation, that means your case gets the time, care and attention it deserves.

One Lawyer, From Start to Finish

Our consultancy model means you deal directly with your lawyer, not a rotating team. You won’t have to repeat your story to different people. Your lawyer keeps you informed at every stage and is on hand when you need reassurance.

Calm, Constructive Approach

Wherever possible, we encourage negotiation and family mediation to reduce conflict, cost and stress. We keep your children’s wellbeing at the centre of every decision, while robustly protecting your position if matters go to court.
