Property Litigation & Dispute Resolution

Property disputes can be stressful, costly and disruptive, whether they involve your home, your investment or your business premises. Woodstock Legal Services acts for investors, landlords, homeowners and leaseholders across England and Wales in all kinds of residential and commercial property disputes.

Our property litigation solicitors advise on boundary and neighbour disputes, rights of way and other easements, service charge disputes, dilapidations claims, breach of covenant and forfeiture, business lease renewals, and the recovery of rent arrears. We also help recover land and premises from squatters and unlawful occupiers, and advise on restrictive covenant applications to the First-tier Tribunal.

We take a commercial, pragmatic approach, with total transparency and open communication. We identify potential issues before they arise and always look for the most effective route to resolution. We’re tough when we need to be, but always focused on protecting your interests.

Commercial & Contract Disputes

When a business dispute arises, it can affect your cash flow, your relationships and your reputation. Woodstock Legal Services helps businesses of all sizes resolve commercial disputes quickly and cost-effectively.

Our commercial litigation solicitors advise on contract disputes, unpaid debts, supplier and customer disagreements, shareholder and partnership disputes, construction and development disputes, and insolvency-related claims. We also act in professional negligence claims against solicitors, valuers and other professional advisers.

We take the time to understand your business and your commercial goals, so our advice is practical and proportionate. Whether the best outcome is a negotiated settlement or robust court proceedings, we’ll help you choose the right strategy and pursue it decisively.

Civil Litigation & Court Proceedings

Not every dispute can be resolved by agreement. When it can’t, you need experienced lawyers who can take your case to court and get the best possible result. Woodstock Legal Services represents businesses and individuals in civil proceedings across England and Wales, including contested probate claims and inheritance disputes.

Wherever possible, we aim to resolve matters without issuing court proceedings, through negotiation, mediation and other forms of alternative dispute resolution. If your case does go to court, our team has the specialist expertise and drive to pursue the best resolution on the best commercial terms.

We know the cost of litigation can feel daunting. We provide fixed fees where possible and, where they’re not, give you a detailed costs estimate and keep you updated at every stage, so you can budget with confidence and make informed decisions about your case.

Dispute Resolution & Litigation FAQs

  • Do I have to go to court to resolve a dispute?

Not necessarily. In fact, most disputes are resolved without a court hearing. The courts expect both sides to try to settle matters first, through correspondence, negotiation or alternative dispute resolution such as mediation, and can penalise parties who unreasonably refuse to engage. Our litigation solicitors always explore the most cost-effective route to resolution first. If court proceedings become necessary, we’ll guide you through every stage and robustly protect your position.

  • How much will litigation cost?

The cost depends on the complexity of the dispute, the amount at stake and how far the case progresses. Where possible, we offer fixed fees for specific stages. Where that’s not possible, we provide a detailed costs estimate and keep you updated throughout. In many cases, the losing party is ordered to pay a proportion of the winner’s legal costs, although you’re unlikely to recover everything. We’ll always give you a realistic view of the costs and potential benefits before you decide how to proceed.

  • How long do I have to bring a claim?

Strict time limits, known as limitation periods, apply to most claims. For example, many contract and negligence claims must be brought within six years, while some claims relating to land and deeds have a 12-year limit. Other claims have much shorter deadlines. If you miss the deadline, you may lose the right to bring your claim altogether, so it’s important to get legal advice as early as possible.

  • What is a letter before claim?

A letter before claim is a formal letter setting out the details of your claim and what you want the other party to do to resolve it. In most cases, the courts expect you to follow a pre-action process, including sending this letter and allowing the other side time to respond, before issuing proceedings. A well-prepared letter before claim often leads to an early settlement. Our solicitors can draft it for you and handle the response.

  • What can I do about a boundary or neighbour dispute?

Boundary and neighbour disputes, including disagreements over fences, access, rights of way, trespass or nuisance, are among the most common property disputes. They can become emotionally charged and expensive if they escalate. We start by reviewing the title documents, plans and history of the property to establish your legal position, then aim to resolve the matter through negotiation or mediation. Where agreement isn’t possible, we can take formal action to protect your rights.

Why Choose Woodstock Legal Services?

Low Caseloads: Your Matter Gets Time

As consultants, our litigation solicitors manage their own caseloads and only work for a handful of clients at any one time. Whether you’re negotiating a settlement or preparing for court, your case gets the time, care and attention it deserves.

Proactive Updates: No Chasing

Our consultancy model means you deal directly with your lawyer, not a call centre or a rotating team. They keep you informed at every stage and are on hand to answer your questions, so you’ll never need to chase.

Commercial, Pragmatic Approach

We focus on the outcome that makes sense for you, not on prolonging a dispute. With fixed fees where possible and clear cost estimates throughout, you’ll get practical advice that protects your interests and keeps risk under control.
