Note: Any work carried out in addition to or outside of the above will be charged at standard hourly rates of the team member carrying out the work.  At the outset of a claim, the fixed fees applicable to the claim would be confirmed to you.  The rates charged by the team are between £250 plus VAT and £350 plus VAT per hour.

Undefended Claims Between £10,000 and £100,000

Note: Fees for debt recovery where the claim is undefended and has a claim value of between £10,000 and £100,000 will be charged on a time-spent basis, charged at the standard hourly rate of the team member carrying out the work.  The rates charged by the team are between £250 plus VAT and £350 plus VAT per hour.  Where it is possible, after review of the matter, we may be able to offer a fixed fee for certain elements of work which would be kept under review throughout the claim.  At the outset, we would always aim to provide you with an estimate of likley fees involved to see the claim through to a conclusion (i.e. obtaining an order in your favour), but as certain elements of the claim would be unknown at the outset, this may change and adapt as more information comes to light.

Defended Claims Up to £100,000

Note: Fees for debt recovery where the claim is defended or becomes defended will be charged on a time-spent basis at the standard hourly rates of the team member carrying out the work.  The rates charged by the team are between £250 plus VAT and £350 plus VAT per hour.  Where it is possible, we would always try to give you an estimate of costs to see the claim through to a conclusion (i.e. a final hearing) but defended claims are subject to lots of variables so it is not always possible to give accurate estimates at the start of a claim, and we would therefore aim to keep you updated through the matter, as the claim progresses.

Counsel’s Fees & Disbursements

The legal fees above do not include disbursements or third-party costs.

Counsel may need to be instructed, for example, to advise on prospects or represent you at a hearing. We will discuss this with you in advance and will only instruct Counsel with your agreement.

Counsel’s fees are usually estimated as follows:

  • Attendance at Tribunal hearing: between £1,000 plus VAT and £1,875 plus VAT per day
  • Initial brief fee: between £1,875 plus VAT and £4,375 plus VAT

Counsel’s fees may vary depending on the barrister’s experience, availability and the complexity of the matter.

Factors That May Make a Case More Complex

A case may become more complex, and costs may increase, if, for example:

  • Applications are required to amend claims or provide further information;
  • The other party is representing themselves;
  • A costs application is made or defended;
  • There are complex preliminary issues;
  • There are a large number of witnesses or documents;
  • The matter involves automatic unfair dismissal;
  • There are linked allegations, such as discrimination or whistleblowing;
  • Counsel is required to advise or attend a final hearing.

Key Stages Included

Depending on the scope agreed, the indicative fees may include:

  • Taking initial instructions, reviewing papers and advising on merits and likely compensation;
  • ACAS early conciliation, where required;
  • Preparing or reviewing the claim or response;
  • Exploring settlement and negotiating where appropriate;
  • Preparing or considering a schedule of loss;
  • Preparing for and attending preliminary hearings;
  • Exchanging documents and agreeing a hearing bundle;
  • Taking and preparing witness statements;
  • Reviewing the other party’s witness statements;
  • Agreeing on a list of issues, chronology and/or cast list;
  • Preparing for and attending the final hearing, including instructions to Counsel where needed.

We will confirm the agreed scope of work at the outset.

Timescales

Timescales depend on the stage at which the matter is resolved and the Employment Tribunal’s availability.

As a general guide:

  • If the matter settles during pre-claim conciliation, it may take around 2 to 16 weeks;
  • If the claim proceeds to a final hearing, it may take up to 52 weeks or more, depending on the Tribunal’s workload and the complexity of the case.

We will provide a more specific estimate once we understand the matter.

Who Will Deal With Your Matter?

Employment Tribunal work is carried out by consultant solicitors with employment law experience. Supervision arrangements will be confirmed at the outset, together with details of the person responsible for your matter and their relevant experience.
