Remortgages at Woodstock Legal Services

Remortgaging can help you secure a better interest rate, release equity or fund home improvements. While it’s simpler than buying a property, there’s still important legal work involved, and delays can mean missing the start date of a new mortgage deal. Woodstock Legal Services helps homeowners and landlords across England and Wales remortgage smoothly and on time.

Our residential property lawyers advise on remortgages to a new lender, releasing equity from your home, remortgages of leasehold and shared ownership properties, buy-to-let remortgages, and remortgages carried out alongside a transfer of equity.

You’ll work directly with an experienced lawyer who explains each step in plain English, liaises with your lender and broker on your behalf and keeps you updated throughout. We’ll make sure the paperwork is right first time, so your new mortgage completes when you need it to.

Switching to a New Lender

When your current mortgage deal comes to an end, moving to a new lender can save you money. Timing matters, though, and the legal work needs to be completed before your new deal can start.

Our lawyers review your new mortgage offer and the title to your property, carry out any searches your lender requires, and report to your lender before completion. On completion, we receive the new mortgage funds, redeem your existing mortgage and register the new lender’s charge with HM Land Registry.

We’ll work efficiently with your lender and broker, flag any issues early and keep you informed at every stage, so you can switch lenders with minimal hassle.

Releasing Equity & More Complex Remortgages

Many homeowners remortgage to release equity for home improvements, to help family members onto the property ladder or to consolidate other borrowing. Some remortgages also involve extra legal steps, for example where the property is leasehold, a buy-to-let or held in shared ownership.

Our property lawyers check that your lease meets your lender’s requirements, deal with any notices to your freeholder or housing association, and make sure everyone with an interest in the property has given the consents your lender needs. If you’re also adding or removing someone from the title, we can handle the remortgage and transfer of equity together.

Whatever your circumstances, we’ll identify potential issues early and explain your options clearly, so there are no last-minute surprises before completion.

Remortgage FAQs

  • Do I need a solicitor to remortgage?

Yes, in most cases. Your new lender will need a solicitor or conveyancer to check the title, register its charge and pay off your existing mortgage. This lawyer acts for both you and your lender. Many lenders only work with firms on their approved panel, so it’s worth checking with your lender or broker early. Our team can confirm whether we can act for you.

  • How long does a remortgage take?

A straightforward remortgage usually takes a few weeks from instruction to completion. The timing depends on your lender, whether searches are needed and whether there are any issues with the title. If you’re also transferring equity, or the property is leasehold, it may take a little longer. We’ll give you a realistic timeline at the start and keep you updated, so you can plan around your new mortgage deal.

  • What do I need to provide to get started?

We’ll need proof of identity and address, details of your new mortgage offer and information about your existing mortgage so we can arrange its redemption. If anyone else aged 17 or over lives at the property, your lender may ask them to sign a form confirming they won’t claim any interest against the lender. Your lawyer will guide you through exactly what’s needed.

  • Can I remortgage a leasehold property?

Yes, but your lender will usually want to see that the lease has enough years remaining and that its terms are acceptable. If your lease is getting short, you may need to extend it before or alongside the remortgage. We’ll review your lease early and let you know if anything needs to be addressed, and our leasehold team can help if an extension is needed.

  • Can I remortgage and transfer equity at the same time?

Yes. If you’re adding or removing someone from the title, it often makes sense to deal with the remortgage and transfer of equity together, especially if the new mortgage is in different names. Your lender will need to approve the new ownership, and we’ll coordinate both transactions so they complete at the same time.
