Remortgages & Transfers of Equity at Woodstock Legal Services

Changing your mortgage or the ownership of your home is a significant decision, even when you’re not moving. Whether you’re switching lenders, releasing equity, adding a partner to the title or removing someone after a separation, the legal side needs to be handled correctly to protect your home and your interests. Woodstock Legal Services helps homeowners across England and Wales with remortgages and transfers of equity.

Our residential property lawyers advise on remortgages to a new lender, equity release for home improvements or other purposes, transfers of equity to add or remove an owner, transfers between spouses and civil partners, including following divorce or dissolution, gifts of a share in a property to family members, and changes to how a property is jointly owned.

You’ll work directly with an experienced lawyer who explains each step in plain English, liaises with your lender on your behalf and keeps you updated throughout. We’ll make sure the paperwork is right first time, so the process is as smooth and stress-free as possible.

Remortgages at Woodstock Legal Services

Remortgaging can help you secure a better interest rate, release equity or fund home improvements. While it’s simpler than buying a property, there’s still important legal work involved, and delays can mean missing the start date of a new mortgage deal.

Our lawyers review your new mortgage offer and the title to your property, carry out any searches your lender requires, and report to your lender before completion. On completion, we receive the new mortgage funds, redeem your existing mortgage and register the new lender’s charge with HM Land Registry. Where you’re also making a change to the ownership of the property, we can handle the remortgage and transfer of equity together.

We understand the importance of timing when you’re moving to a new deal. We’ll work efficiently with your lender and broker, flag any issues early, and explain everything clearly, so you can switch lenders with minimal hassle.

Transfers of Equity at Woodstock Legal Services

A transfer of equity changes the legal ownership of your property without selling it. Common reasons include adding a new partner after marriage or moving in together, removing a former partner following separation or divorce, or gifting a share of the property to a family member.

Our property lawyers prepare and agree the transfer documents, obtain your lender’s consent where there’s a mortgage, and register the change at HM Land Registry. We’ll also advise on whether Stamp Duty Land Tax (or Land Transaction Tax in Wales) may apply, and on how the property should be held going forward, including whether a declaration of trust is needed to record each owner’s share.

Transfers of equity often take place at important or emotional moments in people’s lives. We’ll handle your matter sensitively, explain the implications for everyone involved, and make sure the change is completed correctly and your interests are fully protected.

Lease Extensions FAQs

  • Do I need a solicitor to remortgage?

Yes, in most cases. Your new lender will need a solicitor or conveyancer to check the title, register its charge and pay off your existing mortgage. This lawyer acts for both you and your lender. Many lenders only work with firms on their approved panel, so it’s worth checking with your lender or broker early. Our team can confirm whether we can act for you.

  • How long does a remortgage take?

A straightforward remortgage usually takes a few weeks from instruction to completion. The timing depends on your lender, whether searches are needed and whether there are any issues with the title. If you’re also transferring equity, or the property is leasehold, it may take a little longer. We’ll give you a realistic timeline at the start and keep you updated, so you can plan around your new mortgage deal.

  • Do I need my lender’s consent for a transfer of equity?

Yes, if there’s a mortgage on the property. Your lender will need to approve the change in ownership. If someone is being added, the lender will usually need to assess whether they can afford the mortgage. If someone is being removed, the lender must agree to release them from the mortgage. In some cases, this means arranging a new mortgage at the same time. We’ll liaise with your lender and guide you through what’s needed.

  • Will I have to pay stamp duty on a transfer of equity?

It depends on the circumstances. Stamp Duty Land Tax (or Land Transaction Tax in Wales) may be payable if money changes hands or someone takes on a share of the mortgage, and the value involved is above the relevant threshold. Gifts with no mortgage involved, and transfers between spouses or civil partners as part of a divorce or dissolution, are often exempt. Our lawyers will review your situation and advise you clearly before the transfer goes ahead.

  • What’s the difference between joint tenants and tenants in common?

If you own a property as joint tenants, you own it together as a whole. If one owner dies, their share passes automatically to the surviving owner. As tenants in common, each owner has a defined share that can be left to others in a will. Choosing the right option is important when adding someone to the title. We can explain the difference and help record your agreement with a declaration of trust where needed.
