Residency & Citizenship at Woodstock Legal Services

Settling permanently in the UK and becoming a British citizen are major milestones. The requirements can be detailed and strict, though. Gaps in residence, absences abroad, past immigration issues or missing documents can all affect your eligibility. Woodstock Legal Services helps individuals and families secure their long-term future in the UK.

Our immigration lawyers advise on indefinite leave to remain (ILR), settlement through family, work and long residence routes, switching between immigration routes, British citizenship by naturalisation, registration for children, and British passport applications.

You’ll work directly with an experienced lawyer who reviews your immigration history, confirms when you’re eligible and guides you through every step of the process.

Indefinite Leave to Remain

Indefinite leave to remain gives you the right to live and work in the UK permanently, without time limits. The requirements depend on your immigration route, and the timing of your application is crucial.

Our lawyers carry out careful eligibility checks, review your residence and absences, and give strategic guidance on when and how to apply. In one recent case, our team helped clients who had been placed on the 10-year settlement route after a period of overstaying to switch back to the faster 5-year spouse route, significantly shortening their path to settlement.

Settlement rules are currently under review, so it’s more important than ever to get up-to-date advice before you apply.

British Citizenship

For many people, becoming a British citizen is the final step in their immigration journey. Citizenship gives you the right to a British passport and removes the need for any further immigration applications.

Our immigration team guides you through naturalisation applications for adults and registration applications for children. We check that you meet the residence, good character, knowledge of life in the UK and English language requirements, prepare your application and supporting evidence, and support you through to your citizenship ceremony.

We’ll make sure your application is accurate and complete, so you can take this important step with confidence.

Residency & Citizenship FAQs

  • What is indefinite leave to remain?

Indefinite leave to remain (ILR) is a form of settled status that allows you to live, work and study in the UK permanently, without immigration time limits. It also allows you to access public funds, if eligible, and is usually a step towards applying for British citizenship.

  • When can I apply for ILR?

It depends on your immigration route and how long you’ve lived in the UK. The qualifying periods and requirements differ between routes, and the rules on settlement are currently under review. We’ll check your immigration history and advise you on exactly when you’ll be eligible.

  • What is the Life in the UK test?

The Life in the UK test is a computer-based test on British traditions, history and customs. Most applicants for ILR and naturalisation need to pass it, alongside meeting an English language requirement. Some applicants are exempt, for example because of age or a long-term condition.

  • How do I become a British citizen?

Most adults apply through naturalisation, which usually requires having held ILR or settled status for a period. Applicants also need to meet the residence, good character, English language and Life in the UK requirements. Children may be able to register as British citizens. We’ll confirm your eligibility and prepare your application.

  • Can I lose my indefinite leave to remain?

Yes, in some circumstances. ILR can lapse if you spend a long continuous period outside the UK, usually more than two years. It can also be revoked in certain cases, for example, following serious criminality or deception. If you’re planning extended time abroad, speak to us first.
