Corporate Disputes & Debt Collection at Woodstock Legal Services

When a business relationship breaks down, or invoices go unpaid, it can disrupt your operations and put pressure on your cash flow. Taking the right advice early helps you understand your rights and find the most commercially sensible way to resolve the situation. Woodstock Legal Services helps businesses recover debts and resolve disputes across England and Wales.

Our lawyers advise on unpaid invoices and debt recovery, letters before action, statutory demands, County Court and High Court claims, enforcing judgments, contract and commercial disputes, and disputes with suppliers, customers and business partners.

You’ll work directly with an experienced lawyer who understands how businesses operate, gives you clear, commercially focused advice and helps you resolve the issue as efficiently as possible.

Debt Collection

Late payments and bad debts can quickly affect a business’s cash flow and growth. Acting promptly and following the right process gives you the best chance of recovering what you’re owed.

Our lawyers review the debt and your contract terms, then send a formal letter before action that sets out what’s owed and the consequences of non-payment. Where appropriate, we can also claim statutory interest and compensation on late payments from other businesses. If the debt remains unpaid, we issue court proceedings or, in some cases, serve a statutory demand. Once a judgment is obtained, we advise on the most effective enforcement options.

We’ll help you recover what you’re owed while protecting valuable customer relationships wherever possible.

Commercial & Corporate Disputes

Disputes with suppliers, customers, contractors or business partners can be costly and distracting. Resolving them quickly and on the right terms helps you protect your business and focus on what you do best.

Our lawyers assess your position, advise on your rights under the contract and the law, and recommend the most proportionate route to resolution. Wherever possible, we aim to settle disputes through negotiation or mediation. Where that isn’t possible, we prepare and pursue court claims, or defend claims brought against you. We work closely with our dispute resolution and litigation teams on more complex matters.

Throughout the process, we’ll give you honest advice on your prospects and keep you informed at every stage.

Corporate Disputes & Debt Collection FAQs

  • What should I do if a customer won’t pay?

Start by checking your contract terms and sending a clear reminder. If the invoice remains unpaid, a formal letter before action is usually the next step, setting out what’s owed and giving a deadline for payment. If payment still isn’t made, we can issue a court claim and advise on enforcement.

  • Can I charge interest on late payments?

If your customer is another business, you may be entitled to claim statutory interest and fixed compensation on late payments, unless your contract sets out its own reasonable terms for late payment. We’ll check your contract and include any interest due in your claim.

  • What is a statutory demand?

A statutory demand is a formal demand for payment of an undisputed debt. If the debtor doesn’t pay or respond within the required time, it can lead to bankruptcy proceedings against an individual or winding-up proceedings against a company. It’s a powerful tool, but it isn’t suitable for disputed debts. We’ll advise on whether it’s the right option.

  • How long do I have to recover a debt?

For most contract debts, you have six years from the date the debt became due to bring a claim. However, the longer you wait, the harder it can be to recover the money, especially if the debtor’s financial position worsens. Acting early improves your chances.

  • What happens if the debtor still doesn’t pay after a judgment?

If the debtor doesn’t pay, there are several enforcement options. These include instructing enforcement agents to seize goods, obtaining a charging order over property, a third-party debt order to freeze bank accounts, or an attachment of earnings order. We’ll advise on the most effective option for your situation.
