Intellectual Property at Woodstock Legal Services

Your ideas, brand and creative work are often among your most valuable business assets. Protecting them properly helps you stop others from copying or profiting from your work, and gives you the confidence to grow, license or sell what you’ve created. Woodstock Legal Services advises creators, agencies and businesses across England and Wales.

Our intellectual property lawyers advise on trade mark registration and protection, copyright and creative content, design rights, confidential information and trade secrets, IP ownership and assignments, licensing agreements, and infringement disputes.

You’ll work directly with an experienced lawyer who understands creative and commercial businesses, explains your rights in plain English, and helps you protect and make the most of what you’ve created.

Protecting & Owning Your IP

Many businesses assume they own the logos, content, designs or software they’ve paid for, but that isn’t always the case. Without the right written agreement, the rights may stay with the freelancer, agency or contractor who created the work.

Our lawyers help you identify your key intellectual property and make sure it’s properly protected and owned. We advise on registering trade marks, protecting copyright and designs, and keeping confidential information secure. We also draft assignments and agreements with employees, freelancers and agencies, so the rights to the work you’ve commissioned belong to your business.

We’ll help you build a strong foundation of IP protection that supports your brand and adds value to your business.

Licensing, Creative Content & Disputes

Licensing your IP can create new revenue streams and partnerships, but the terms need to be clear to protect your rights. When someone uses your work without permission, acting quickly can stop the damage and protect your reputation.

Our intellectual property lawyers draft and negotiate licensing, collaboration and content agreements for creators, agencies, influencers and brands. Where your rights have been infringed, we advise on your options and send cease and desist letters. We also negotiate settlements and, where needed, take further action with our dispute resolution team. If you’ve been accused of infringing someone else’s rights, we’ll help you respond.

Whether you’re licensing your work or protecting it, we’ll give you clear, practical advice.

Intellectual Property FAQs

  • Should I register a trade mark?

Registering a trade mark gives you exclusive rights to use it for the goods and services it covers, making it much easier to stop others using a similar name or logo. Unregistered marks can sometimes be protected, but it’s usually harder and more expensive to enforce them. We can advise on searching, applying and protecting your mark.

  • Do I own the copyright in work I’ve paid for?

Not automatically. When work is created by a freelancer, agency or contractor, the copyright usually stays with the creator unless it’s assigned to you in writing. Work created by employees in the course of their employment generally belongs to the employer. We’ll make sure your agreements give you the rights you need.

  • How is copyright protected in the UK?

Copyright arises automatically when an original work, such as writing, artwork, photography, music or software, is created. There’s no need to register it in the UK. Keeping records of when and how your work was created can help if you ever need to prove ownership.

  • What is a licensing agreement?

A licensing agreement allows someone else to use your intellectual property, such as a brand, design or content, in return for a fee or royalty, while you keep ownership. It sets out how the IP can be used, where, for how long and on what terms. We’ll draft or review licences to protect your interests.

  • What should I do if someone copies my work?

Gather evidence of your work and the copying, and avoid making public accusations. A lawyer can assess whether your rights have been infringed and send a cease and desist letter, which often resolves the issue. If it doesn’t, we’ll advise on further action.
